The FTC had a bad week – losing what may turn out to be a precedent setting case concerning Microsoft’s acquisition of Activision. This makes Microsoft the third largest video game publisher (behind Tencent and Sony) and will now own massive titles such as Call of Duty, Diablo, and Warcraft.

Current FTC chair Lena Kahn has become known for bringing somewhat speculative anti-trust cases regarding vertical integration. Lena and her supporters believe that, despite losing cases like this one, bringing aggressive suits draws attention to potential issues which benefit their political agenda over the longer term.

Smart traders will be on the lookout for more dicey cases like this one! Expect stocks to dip a bit upon the lawsuit announcements, but then come back when the company ultimately wins the case. Keep an eye out for more overreaching anti-trust cases in the pipeline. The FTC’s predictable failures in court can be your financial gain 🙂
